Welcome to BidMosaic ("BidMosaic", “we,” “us,” or “our”). By accessing or using the BidMosaic platform, including any websites, applications, or services (collectively, the “Service”), you agree to be bound by these Terms of Use and policies. If you do not agree, you must not use the Service.

1. Overview of the Service

BidMosaic is an interactive platform that allows users to create, modify, and display visual content on shared mosaic canvases using virtual credits. Content is user-generated and publicly visible.

2. User Content and Responsibility

You are solely responsible for all content you create, upload, modify, or display through the Service (“Content”).

By submitting Content, you represent and warrant that:

• You own or have the necessary rights to use and display the Content
• Your Content does not violate any laws, regulations, or third-party rights
• Your Content complies with this Agreement

BidMosaic does not endorse and is not responsible for user-generated Content.

3. Acceptable Use and Prohibited Content

You agree not to use the Service to create, upload, display, or distribute Content that:

3.1 Sexual and Exploitative Content

• Contains pornography, sexually explicit material, or obscene content
• Depicts nudity intended to arouse sexual interest
• Includes non-consensual intimate imagery (including “revenge porn”)
• Exploits or endangers minors in any way

3.2 Harassment and Abuse

• Includes hate speech, harassment, threats, or abusive language
• Targets individuals or groups based on protected characteristics
• Encourages or glorifies violence

3.3 Illegal or Harmful Activity

• Promotes or facilitates illegal activities
• Contains fraudulent, deceptive, or misleading content
• Violates intellectual property or privacy rights

3.4 General Prohibition

• Is otherwise offensive, inappropriate, or harmful, as determined by BidMosaic in its sole discretion

These standards are interpreted broadly and in line with widely accepted policies used by major public content platforms.

4. Enforcement and Moderation

BidMosaic reserves the right, at its sole discretion and without notice, to:

• Remove, block, or modify any Content
• Restrict, suspend, or terminate user accounts
• Limit or revoke access to the Service

We may take these actions at any time, including for suspected or alleged violations, without prior warning.

5. Credits, Payments, and No Refund Policy

5.1 Credits

• The Service uses virtual credits to enable participation
• Credits have no cash value and are not redeemable for currency
• The credits are referred to as Funds

5.2 Purchases

• All credit purchases are final and non-refundable
• Credits may be used for future activity on the Service
• Credits do not expire

5.3 Removed Content

If Content is removed for violating this Agreement:

• Any credits used to create or modify that Content will not be refunded
• No compensation will be provided

6. Copyright and DMCA Policy

BidMosaic respects intellectual property rights and expects users to do the same.

6.1 Prohibited Infringement

You may not upload or display Content that infringes the copyrights, trademarks, or other intellectual property rights of others.

6.2 DMCA Takedown Requests

If you believe that Content on the Service infringes your copyright, you may submit a notification under the Digital Millennium Copyright Act (“DMCA”) including:

• Your name and contact information
• Identification of the copyrighted work claimed to be infringed
• Identification of the infringing Content (including location/URL)
• A statement that you have a good faith belief the use is not authorized
• A statement under penalty of perjury that the information is accurate
• Your physical or electronic signature

6.3 Counter-Notification

Users may submit a counter-notification if they believe Content was removed in error, in accordance with applicable law.

6.4 Repeat Infringers

BidMosaic may terminate accounts of users who repeatedly infringe intellectual property rights or violate these terms of use.

7. Termination

We may suspend or terminate your access to the Service at any time, for any reason, including violation of these Terms.

8. Disclaimer of Warranties

The Service is provided “as is” and “as available.” BidMosaic makes no warranties, express or implied, regarding the Service, including availability, reliability, or fitness for a particular purpose.

9. Limitation of Liability

To the fullest extent permitted by law, BidMosaic shall not be liable for:

• User-generated Content
• Removal or modification of Content
• Loss of credits, funds
• Loss of data
• Any indirect, incidental, or consequential damages

10. Changes to These Terms

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.
